Right of Withdrawal
Consumers within the European Union have the right to withdraw from the contract within 14 days without giving reasons, pursuant to §§ 312g, 355 BGB. The withdrawal period begins on the day the contract is concluded. To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g., email). You may use the statutory model withdrawal form, but this is not mandatory.
Liability Limitations
The Provider is liable without limitation for damages caused by intent or gross negligence. For slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), limited to the foreseeable, typically occurring damage. Liability for loss of life, bodily injury, or damage to health remains unaffected. These limitations do not apply to claims under the Product Liability Act.
Warranty
The statutory warranty provisions (Gewährleistung) apply. The Provider does not guarantee uninterrupted or error-free availability of the service, but will make commercially reasonable efforts to maintain service quality.
Termination
Either party may terminate the contract at any time. Users may terminate by deleting their account or by sending written notice. The Provider may terminate with reasonable notice. The right to terminate for cause remains unaffected.
Data Protection
Personal data is processed in accordance with our Privacy Policy and the applicable data protection laws (GDPR, BDSG).
Amendments
The Provider may amend these terms with reasonable prior notice. Users will be notified of changes by email or through the platform. Continued use of the service after the notice period constitutes acceptance of the amended terms.
Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the original provision (Salvatorische Klausel).
Governing Law and Jurisdiction
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes is Kiel, provided the user is a merchant, a legal entity under public law, or has no general place of jurisdiction in Germany.
